COPYRIGHT, USAGE RIGHTS & CONSENT AGREEMENT

1. COPYRIGHT & USAGE RIGHTS OF PHOTOGRAPHS:On purchasing digital files you accept that Aussie Photo Media grants you a non-exclusive perpetual personal-use license to download images for a single use, non-exclusive, royalty-free licence for the following: Print: reproduction, distribution and communication of the image for the purposes. ALL photographs remain subject to the following restrictions:

This license is for Personal Use Only. Personal use means non-commercial use of the photographs for display on personal websites and computers or making prints copies personal use. The Photographs may not be used in any way whatsoever in which you charge money, collect fees, or receive any form of remuneration or recognition. The Photographs may not be used in competitions, advertising, be re-edited, re-sold, re-licensed, or sub-licensed. 

Should this licence condition be breached, and any Photograph supplied by Aussie Photo Media is re-edited or tampered with by a client in any way whatsoever, under no circumstances are these files to be published online, in print or by any other means. They are not to be credited to Aussie Photo Media. No responsibility will be taken by Aussie Photo Media for files edited by any third party.

Express prior permission from Aussie Photo Media may be requested under exceptional circumstances. Should permission be granted conditions will apply. 

Copyright (title and ownership), now and in the future, of and for the Photographs remain exclusively with Aussie Photo Media.

There are no warranties, express or implied. The Photographs are provided ‘as is.’ Aussie Photo Media will not be liable for any third-party claims or incidental, consequential or other damages arising out of this license or buyer’s use of the Photographs.

2. CONSENT: The client consents that their name and the photographs taken and presented by this photographer may be used by Aussie Photo Media for the purpose of display, portfolio, advertising, website or any publication, directory or forum; printed or online; to promote the studio or name. The Client also agrees that the images taken by Aussie Photo Media can be used without additional compensation to them, the Client. If the Client does not consent to this item, Aussie Photo Media must be notified in writing prior to the shoot whenever possible, or as soon as possible after the event. All respect will be given to a clients’ expressed request to non-consent.

Operation of Terms:

1. This service is provided by Aussie Photo Media, ABN 65 957 720 331
2. By purchasing a Personal Licence and (if applicable) the Extended Licences (“Licence”) to exploit an Image by means of this website www.aussiephotomedia.com.au (or other URL or platform operated by Aussie Photo Media), you are deemed to accept these Terms and Conditions.
3. Licence Fees may be paid for by credit card or other payment service provided for in the Website, according to the terms of the relevant financial institution.
4. Aussie Photo Media may provide you with a password to enable access to the Images. This must be kept in a secure place and must not be disclosed to any third party.
5. If you breach any material term of these terms and conditions, we may terminate our agreement with you with or without written notice to you.
6. If you are purchasing on behalf of your employer or as an agent on behalf of a third-party principal, the employer or principal is deemed to accept these Terms and Conditions and you warrant and represent that you have the full right and authority to bind that employer or principal. In the event that you do not have such authority, you agree that you will be personally liable to Aussie Photo Media for any breaches of these Terms and Conditions.
7. Each licence is for use in relation to one product, publication or project only.
8. Except as provided for in this clause, you must not sub-licence or assign the rights granted to you under any Licence. Should a third-party wish to exercise those rights, they may purchase a Licence on their own account. You are permitted to transfer files containing the Image or permitted derivative works to a third-party (such as a printer) temporary copies for the purpose of exercising the rights granted to you under a Licence.
